About This Policy
We believe that delivering consistently high-quality dentistry must be a routine for services provided. That is why we created the ArtSmiles Warranty Policy, which is part of the Quality Assurance Program. The Warranty Policy is relevant to reassure patients about the highest standard of dentistry delivered by ArtSmiles clinical team, as well as to identify what is and is not covered by the warranty policy.
We recognise that patients are not experts in dentistry and, considering the high cost of dental treatments, there is certain expectation of longevity of dental treatments. However, the longevity of dental service is not related only to the service provided by the clinician, but patient's adherence to prevention is fundamental for long-term results.
The purpose of this Policy is to provide clear guidelines to all staff and patients, with respect to our:
- Warranty policies, procedures included, and protocols
- Expectations of service delivery
- Exclusions of warranty
What Is Covered
Subject to the terms and conditions stated below, ArtSmiles will repair or replace without any charge to the Patient any covered treatment that fails due to faulty materials or workmanship, provided that the patient has fulfilled his or her Patient Responsibility as described herein.
What Is Not Covered
This Limited Warranty does not cover:
- Procedures not listed in the Treatment eligible for coverage
- Preexisting conditions
- Cosmetic discoloration
- Patient’s non compliance with good oral health
- Failure of a Covered Treatment due to:
- failure of Patient to comply with Patient Responsibilities
- other treatments
- medical conditions resulting from substance abuse
- medical conditions that cause damage to oral structures
Conditions of Coverage
The Standard Warranty covers repairs or the replacement of treatments due to normal use, considering that:
- The treatment consented and executed corresponds to the procedure technically recommended by the ArtSmiles dental practitioner, and there is no “Notice of Non-ideal Treatment” signed
- The maintenance and oral hygiene instructions given by the ArtSmiles practitioner are followed properly
- Patient continues under ArtSmiles care, attending recommended maintenance appointments (minimum every 6 months unless otherwise stated)
- Patient does not grind or clench their teeth, or wears a mouthguard to prevent grinding, as specified by the practitioner
- Patient’s gum tissue or bone level are not naturally receding
- No general illness occurs which leads to negative effects on the patient’s dental health and restorations (e.g. diabetes, epilepsy, osteoporosis, cancer, chemotherapy)
- The patient does not smoke (Clinical studies show that smoking is associated with a variety of oral conditions including: periodontal disease, bone loss, tissue loss, tooth loss, edentulism, peri-implantitis and dental implant failure. Smoking is most detrimental to dental implants restorations but it is also bad for conventional crowns/bridgeworks)
- No other dental practice carries out any corrective procedure on the treatment received from ArtSmiles without prior consent
- The patient informs ArtSmiles as soon as problems occur. In the event of defective work found in a covered treatment, patient must notify ArtSmiles within a reasonable time after discovery (not to exceed 7 days) and schedule and attend an appointment at ArtSmiles for corrective actions. Patient’s failure to timely notify ArtSmiles or to attend a scheduled appointment may result in reduction or invalidation of the warranty coverage
Dental Warranty Term
The Coverage has its effect at the time that the Covered Procedure is executed and is valid until the end of the specified time of warranty for that procedure. For example, if a procedure with 5 years warranty is completed on 01/01/2020, then this procedure is covered until 01/01/2025, considering the patient is committed to ArtSmiles Dental Preventive Program, as specified below.
Dental Treatment Maintenance Agreement
Subject to the terms and conditions stated below, ArtSmiles agrees to provide care and services to Patient reasonably necessary to maintain Patient's Covered Treatment(s) in good condition and working order.
ArtSmiles Dental Preventive Program
There is no long-lived treatment without patient's adherence to preventive measures, such as routine professional clean and changes in patient's behaviour, and every patient who is entitled for warranty must, therefore, adhere to ArtSmiles Dental Preventive Program.
Beginning after the Treatment Date, Patient is entitled to ArtSmiles Dental Preventative Program as prescribed by the dental practitioner for the duration of this agreement. This preventive program can be composed by consultations every 3, 4 or 6 months, but not more than 6 monthly. These visits are composed by oral examination (yearly) and cleaning (3, 4 or 6 months), remineralisation with fluoride (6 monthly) and x-rays (every 2 years or earlier, as needed). Additional preventive services may be necessary to inhibit evolution of oral diseases.
Extended Benefits
This is a membership created by ArtSmiles which comprehends the most important preventative procedures. The members also enjoy discounts on all treatment offered by ArtSmiles. Moreover, the warranty policy is expanded for these members. For more information, visit the ArtSmiles Club page.
Maximum Coverage Amount
ArtSmiles shall provide the care and services necessary to maintain Patient's Covered Treatment(s) in good condition and working order at no charge to Patient up to a value equal to the Treatment Cost.
Treatment Cost is the total amount paid to ArtSmiles by or on behalf of Patient for the Dental Treatment subject to maintenance under this agreement. If the cost of maintenance exceeds Treatment Cost, ArtSmiles will deduct the Treatment Cost paid from the charges associated with necessary additional or alternative treatment(s).
Warranty Disclaimer / Remedy Limitation / Damages Exclusion
This Limited Warranty and/or Maintenance Agreement is a complete statement of ArtSmiles warranty obligations. ArtSmiles makes no other warranties, written or express. Unless prohibited by the governing law, all implied warranties, including any implied warranties of merchantability and fitness are excluded. The warranty is ineffective if our instructions are not followed properly. The warranty is ineffective if oral hygiene is neglected. The warranty cannot be applied to temporary restorations. The warranty is ineffective if a patient has gum or periodontal disease for which we have not provided the gum treatment.
The warranty cannot be applied to unforeseen root canal treatment. The warranty cannot be applied to any existing root canal treated tooth done before if the tooth is broken. Only the prosthetic work part is warranted. Refund is not part of the warranty. To invoke the warranty you must contact our clinic immediately and before taking any other action.
We do not reimburse dental expenses made by other dentists post treatment nor do we reimburse travel and accommodation expenses traveling back for our warranty claims. We do not take responsibility for prior or continual dental works done by other dentists. The warranty also does not cover damage of dental work caused by or related to other dentists work done post treatment.
Patient's sole recovery for breach of this Limited Warranty or any implied warranty shall be damages in an amount not to exceed Treatment Cost, that is, the amount paid to ArtSmiles for a failed Covered Treatment. In no event shall ArtSmiles clinicians be liable for incidental or consequential damages.
Other Available Coverage
ArtSmiles reserves the right to require Patient to submit claims on Covered Treatment(s) under any available insurance or other medical or accidental health benefit programs prior to obtaining service under this Limited Warranty and/or Maintenance Agreement.

- Additional procedures when the tooth filled is damaged by trauma
- Anaesthetic complications, such as allergic reaction or nerve injury
- Need for more extensive procedures, especially when the cavity is large
- Unreal cosmetic expectations

Standard Warranty: All patients who comply with the responsibilities specified in the Warranty Policy and do not fall within the limitations specified in the terms and conditions are eligible for one year standard coverage.
Extended warranty – ArtSmiles Club: All patients who comply with the responsibilities specified in the Warranty Policy and do not fall within the limitations specified in the terms and conditions are eligible for three years comprehensive coverage.
